Attorneys Examine Northrop Ruling’s Effect on Insurability of Settlements

Cary Lerman weighs in on the U.S. Court of Appeals’ recent decision in Axis Reinsurance Co. v. Northrop Grumman Corp. The ruling, which was decided in Northrop Grumman’s favor, calls into question whether and when settlement-based disgorgement payments, not excluded by the terms of a policy, may be excluded from insurance coverage based on public policy.
