Munger, Tolles & Olson’s Jacob Kreilkamp, Adam Weiss and James Salzmann Author Article on Defending California’s Unfair Competition Claims

Munger, Tolles & Olson partners Jacob Kreilkamp and Adam Weiss and associate James Salzmann authored an article titled “4 Paths To Defending Calif. Unfair Competition Claims,” published by Law360. 

In the article, Mr. Kreilkamp, Mr. Weiss and Mr. Salzmann discussed the nuances of California’s unfair competition law (UCL) and ways in which counsel can defend against its seemingly broad—but not limitless—scope. In their analysis of four specific paths to resolution of UCL claims—federal preemption, state preemption, the potential unavailability of the relief sought and statutory standing—the attorneys emphasized that by staying up-to-date with the defenses available under the UCL, practitioners can ensure that their clients’ fair and lawful competition remains intact.
