MTO Files Amicus Brief on Behalf of Senator Wyden and former Rep. Cox in Support of Section 230 of the Communications Decency Act

Munger, Tolles & Olson represented U.S. Senator Ron Wyden, D-Ore., and former Representative Chris Cox, R-Calif., the co-authors of Section 230 of the Communications Decency Act, in an amicus brief filed in the U.S. Supreme Court in a case involving the scope of Section 230’s liability protections. 

The underlying case involves allegations that Google is liable for alleged harms caused by third-party content suggested to users by YouTube’s algorithms.  

The amicus brief argues that under the ordinary-meaning interpretation of Section 230, Google is entitled to immunity because Section 230 provides protections to internet platforms from liability involving targeted recommendations in the same way that it protects other forms of content presentation.
