Munger, Tolles & Olson Secures Complete Defense Verdict on Behalf of FIGS and Its Co-Founders
Following four years of aggressive federal court litigation in the Central District of California, a Munger, Tolles & Olson team led by Jacob S. Kreilkamp and Adam B. Weiss obtained a full and complete defense jury verdict in favor of direct-to-consumer medical apparel company FIGS Inc. and its two co-founders, Catherine “Trina” Spear and Heather Hasson.
The MTO team, alongside lawyers from Bird, Marella, Boxer, Wolpert, Nessim, Drooks, Lincenberg & Rhow P.C., successfully defended FIGS, Ms. Spear and Ms. Hasson against Lanham Act false advertising and intentional interference with prospective economic relations claims brought by industry incumbent Careismatic Brands, Inc., formerly Strategic Partners, Inc.
On Nov. 3, 2022, following a nearly three-week trial, a federal jury in Orange County, California returned a verdict for FIGS on all four Lanham Act false advertising claims; ruled in FIGS’, Ms. Spear’s and Ms. Hasson’s favor on state law claims of intentional interference with prospective economic relations; and returned a special interrogatory providing that FIGS had successfully established SPI’s unclean hands by virtue of SPI having previously made marketing claims similar to those it challenged in the litigation.
