Complete Arbitration Victory for IX Holdings

Munger, Tolles & Olson secured a complete arbitration victory for Innovation X Holdings QP (“IX Holdings”) in its dispute with venture capital firm K5 Global Technology, LLC (“K5”). Following a week-long evidentiary hearing, the Honorable Elizabeth Allen White (Ret.) ruled in favor of IX Holdings on all claims and counterclaims, permanently enjoined K5 from removing IX Holdings from a K5-managed fund that was an early investor in SpaceX, and awarded IX Holdings more than $14.6 million in attorneys’ fees and costs. On August 3, 2026, MTO filed a motion in Los Angeles County Superior Court seeking confirmation of the final arbitration award.
The dispute arose after K5 attempted to remove IX Holdings from the fund and redeem its interest at less than 3% of its present-day value, which IX Holdings estimates at approximately $300 million. The arbitrator found that K5 breached its contractual obligations, acted in “bad faith” toward IX Holdings, and violated its fiduciary duties and the implied covenant of good faith and fair dealing.
