Munger, Tolles & Olson attorneys Allison Day and Nate Sussman recently authored chapters in the 2026 edition of eDiscovery for Corporate Counsel, published by Thomson Reuters/Westlaw. The publication includes updates addressing emerging technology, artificial intelligence, information governance and evolving discovery obligations in complex litigation and investigations.

Allison Day authored a fully revised chapter, “Bring Your Own Device or ‘BYOD,’” which examines the growing legal and practical challenges associated with employees’ use of personal devices for work. The chapter discusses evolving case law concerning preservation, collection, privacy and “possession, custody or control” issues in discovery, and provides practical guidance for companies implementing or reevaluating BYOD policies in light of emerging technologies and increasingly complex discovery obligations.

Nate Sussman authored “Generative Artificial Intelligence: Opportunities, Challenges, and Considerations for Attorneys,” which examines the rapidly developing role of generative AI in legal practice. The chapter includes updates since its first publication in 2024 and explores ideas regarding the role of generative AI tools in legal research, drafting, document review and strategic analysis, while also addressing ethical, confidentiality, privilege, accuracy and governance considerations associated with the technology.
