Brian Rivas Boessenecker

Brian Rivas Boessenecker is a litigation associate in the Los Angeles office of Munger, Tolles & Olson.

Mr. Boessenecker focuses his practice on securities class actions, shareholder derivative litigation in the Delaware Chancery, and government investigations. Mr. Boessenecker also has experience in commercial litigation (representing both plaintiffs and defendants) and advising clients in regulatory proceedings before the California Public Utilities Commission.

Mr. Boessenecker earned his J.D. with high honors from the University of Chicago Law School, and was elected to the Order of the Coif and selected as a Kirkland and Ellis Scholar. During law school, Mr. Boessenecker worked for a Chicago-based proprietary trading firm, was a member of the Latinx Law Student Association, and led the law school’s Trivia Board. He received a B.A., summa cum laude, in political science from UCLA.

Prior to joining the firm, Mr. Boessenecker clerked for Judge Stephen V. Wilson of the U.S. District Court for the Central District of California.

Experience

  • Counsel for Berkshire Hathaway in a billion-dollar dispute with Pilot Corporation regarding the Pilot Flying J truck stop chain. Two days before trial was set to begin in Delaware Chancery Court, the parties reached a settlement under which Berkshire acquired 100% of the company.
  • View, Inc. in federal securities and shareholder derivative litigation.  Mehedi v. View, Inc., 2023 WL 3592098 (N.D. Cal. May 22, 2023) (dismissing for failure to state a claim).
  • Mattel in federal securities litigation.
  • PG&E in connection with regulatory proceedings before the California Public Utilities Commission.
  • BlackSand Capital LLC, owner of the Waikiki Galleria Tower in Honolulu, Hawai’i, in a suit against Galleria Tower’s primary tenant, DFS Group. Eight months after BlackSand filed suit, the parties reached a $150 million agreement to resolve the dispute.
  • Multiple clients in investigations by the SEC and DOJ.
