Overview

Vincent Ling focuses his practice on intellectual property litigation, particularly patent infringement and trade secret misappropriation matters. He has significant experience at both the trial and appellate levels.

Vinny advises clients on their most challenging intellectual property issues from the investigation stage all the way through litigation and appeals. He has substantial trial experience in courts nationwide, including in the District of Delaware, Northern District of California, Central District of California and Eastern District of Texas.

He has also worked on high-profile patent appeals, including the reversal of a jury verdict of over $1.2 billion on behalf of Kite Pharma, Inc., a subsidiary of Gilead Sciences, in litigation over the cancer treatment Yescarta®. He is currently counsel for Google in the Federal Circuit’s en banc proceedings in EcoFactor v. Google, relating to the admissibility of damages expert testimony.

Vinny has represented both plaintiffs and defendants in litigation across a range of industries, including computer and networking technologies, semiconductors, banking and finance, and biopharmaceuticals.

Experience

Intellectual Property – Motions Practice and Trials

Google in various patent infringement matters, including

  • helping to obtain a complete defense verdict following trial in the District of Delaware over functionality in Google’s Pixel smartphones and mobile apps; and
  • securing a favorable settlement in a multi-patent case in the Eastern District of Texas involving tap-and-pay technology.

Intel in cross-border patent litigation involving programmable logic devices in the Western District of Texas and Tokyo District Court, and in IPR proceedings successfully obtaining institution on all claims.

Dell in patent litigation involving a portfolio of Wi-Fi 6 standard-essential patents in the Western District of Texas.

Amgen in obtaining a favorable settlement on the eve of trial, resolving a trade secrets dispute brought against Coherus BioSciences involving the biologic drug Neulasta®.

Applied Materials in a case regarding the alleged misappropriation by former employees of trade secrets relating to the manufacturing of LEDs and lithium-ion batteries. Vinny also represented Applied Materials’ interests as the victim in a related criminal trial resulting in the conviction of a former employee.

PNC Bank, one of the largest banks in the United States, in limiting the damages awarded in multiple patent infringement lawsuits filed by United Services Automobile Association (USAA) in the Eastern District of Texas relating to remote check deposit technology.

Checkr, Inc. in a matter defending against allegations of trade secrets theft, unfair competition and breach of contract.

YipitData, a subsidiary of the Carlyle Group, in bringing an action for trade secret misappropriation in the Southern District of New York.

Intellectual Property – Appeals

Google in en banc proceedings at the Federal Circuit in EcoFactor v. Google, relating to the admissibility of expert testimony on patent damages.

Kite Pharma, Inc., a subsidiary of Gilead Sciences, in helping to win a high-stakes intellectual property battle at the Federal Circuit and Supreme Court, overturning a multi-billion-dollar judgment over the cancer treatment Yescarta®.
