Experience
Complex Litigation
- OpenAI in defending against a trade secrets and unfair competition lawsuit brought by xAI in the Northern District of California.
- National Fire Protection Association (NFPA), a major standard-setting organization, in copyright litigation challenging NFPA’s ability to protect standards from infringement after government bodies incorporate them by reference.
- Hawaiian Electric Industries, Inc., and subsidiaries in securing a historic $4 billion settlement resolving litigation related to the devastating 2023 Maui wildfires, including the Lahaina Fire, which was the deadliest U.S. wildfire in over a century. Appellate
- An energy company in appellate proceedings arising from an eight-figure jury verdict award to plaintiffs in a personal injury action.
- Numerous clients in appeals from adverse immigration decisions in federal courts of appeals. Joey successfully briefed and argued Davis v. Financial Services
- Wells Fargo Bank, N.A. in obtaining complete dismissal of a lawsuit brought by a celebrity chef and restaurateur alleging that Wells Fargo was responsible for his losses resulting from a former employee’s alleged embezzlement.
- Huntington Bancshares Incorporated and certain of its officers and directors in a shareholder case under the Securities Act of 1933 focusing on the decline in stock prices that this and other regional banks suffered when Silicon Valley Bank failed. The case was dismissed with prejudice following a single round of motion practice.
