Trials

Munger, Tolles & Olson’s trial attorneys have earned a national reputation for guiding clients through seemingly insurmountable crises. Whether defending a drilling company involved in the nation’s largest environmental disaster or one of the nation’s largest banks against allegations of financial mismanagement, we excel at untangling our clients’ thorniest legal challenges, offering novel litigation strategies, and connecting with juries and judges at trial.

Munger Tolles litigators are known as much for providing long-term strategic leadership on cases as for their remarkable ability to parachute in on the eve of trial. We have prevailed in trials after decades of hard-fought litigation, and we have won astonishing trial victories despite having only a few weeks to prepare.

Munger Tolles lawyers are not only superior legal practitioners—we love trying cases. When clients choose our attorneys to represent them, they send an unmistakable message to the opposition that they are ready and willing to go trial if necessary and that their case will be litigated aggressively at every step.

Among the firm’s recent trial successes, we represented:

  • Philip Morris USA in prevailing at trial in a class action lawsuit that spanned 16 years and sought billions of dollars for alleged fraud and unfair business practices in connection with the marketing of “Marlboro Lights” cigarettes. The trial victory was named one of the Daily Journal’s Top Verdicts of 2013 in the “Top Defense Results” category.
  • Transocean, owner of the Deepwater Horizon drilling rig, in obtaining a defense verdict in litigation arising from the 2010 oil spill in the Gulf of Mexico. By finding that Transocean’s conduct did not void the companies indemnity agreements, Transocean avoided billions of dollars of liability. The American Lawyer named the matter among the “most fascinating big business cases of 2014” and recognized our lead trial counsel on the case as a “Litigator of the Week.” The verdict also earned the trial team a 2015 California Lawyer Attorney of the Year (CLAY) Award.
  • Wells Fargo Bank in obtaining a unanimous jury verdict for the defense in a bellwether lawsuit brought in St. Paul, Minnesota federal court by pension funds for nurses, nuns, local philanthropic organizations and a local university, alleging mismanagement of pension investments in a securities lending program.

Munger Tolles litigators are brilliant problem solvers and fearsome trial opponents, consistently recognized for setting the highest standard of excellence in the courtroom. Counted among our trial lawyers are four fellows of the elite American College of Trial Lawyers, two former chairs of the ABA Section of Litigation, 11 former Assistant United States attorneys and several attorneys who are perennially ranked among the Daily Journal’s top 100 lawyers in California. One of our trial lawyers is also a fellow in the International Academy of Trial Lawyers and identified by Chambers USA as one of the top 19 trial attorneys in the country. In 2014 and 2015, The Recorder recognized Munger Tolles as having one of the top litigation practices in California.
