Munger, Tolles & Olson Partner Malcolm Heinicke has been named to the Daily Journal’s 2026 Top Labor and Employment Lawyers list, which honors California’s leading labor and employment attorneys. This marks the 18th consecutive year that Malcolm has been recognized. 

Malcolm’s profile highlights his nearly three decades of employment law experience and several notable victories. Among the recent matters highlighted is Malcolm’s representation of Pacific Bell in a wage-and-hour class action involving federal preemption under a collective bargaining agreement. There, the district court denied remand and dismissed all claims without leave to amend, establishing a defense framework for employers facing wage-and-hour claims from unionized employees. The profile also recognizes Malcolm’s successful representation of Garda CL West, Inc. in wage-and-hour litigation, as well as his work obtaining Rule 11 sanctions after identifying AI-generated fictitious citations in litigation involving the Phoenix Suns. 

Reflecting on his approach to litigation, Malcolm emphasizes the importance of preparing cases as though they may be tried. “That means developing the factual record early, identifying themes that will resonate with a judge or jury, and helping witnesses communicate clearly and credibly,” he said.
