Munger, Tolles & Olson attorneys Bethany W. Kristovich and Maria Jhai published an article in the Daily Journal on Feb. 21, 2018 outlining best practices for preparing and delivering effective cross-examinations.
The authors write that attorneys should view cross-examinations as an opportunity to gain free points with the jury, undermine the opponents’ case and remind the jury of their affirmative story. They discuss the different steps attorneys should take when preparing a cross-examination and provide a guide for attorneys to follow when drafting a cross-examination. Ms. Kristovich and Ms. Jhai also highlight best practices for handling a cross-examination in the courtroom.
Ms. Kristovich focuses on complex civil litigation, with a particular emphasis in high-stakes trials, class actions and contract disputes.
