Munger, Tolles & Olson Co-Managing Partner and trial lawyer Brad D. Brian joined judges and the nation’s leading trial lawyers in discussing strategies for winning commercial cases at trial at the American Bar Association New York Annual Meeting on Aug. 10, 2017.
Along with Mr. Brian, the panel of luminaries included name partner Stephen Susman of Susman Godfrey; trial ace Ted Wells of Paul Weiss; the legendary James Quinn, who spent his legal career at Weil Gotshal; Chief Judge Barbara M.G. Lynn of the U.S. District Court for the Northern District of Texas; Judge Loretta A. The panel shared insights and practical advice to help attorneys succeed in commercial trials. Speakers discussed techniques and procedures for advancing a client’s interests during commercial trials, as well as potential pitfalls. They also addressed critical trial elements including jury selection, opening statements, direct and cross examinations, evidence, expert witnesses, trial and post-trial motions, damages, appeals and settlement techniques.
Mr. Brian and fellow panelists reflected on their ABA program in an interview with Legal Talk Network. They shared highlights from the program, including the importance of opening statements, the jury system and tips for presenting evidence effectively.
A former chair of the ABA Section of Litigation, Mr. Brian is a Fellow in the American College of Trial Lawyers and the International Academy of Trial Lawyers, and he is ranked by Chambers USA as one of the top 21 trial attorneys in the country.
