A Munger, Tolles & Olson team’s complete defense verdict was named a “Top Defense Result” in the Daily Journal’s “Top Verdicts of 2015” published Feb. 17, 2016.
In Pryor v. Overseas Administrative Services Ltd., a four-lawyer Munger Tolles team of Malcolm A. Heinicke, Martin D. Bern, Marja-Liisa Overbeck and Bryan H. Heckenlively, won a complete defense victory for their client after a three-month class arbitration trial. Represented by four law firms, the certified class of nearly 7,000 truck drivers who worked for United States military contractors in Iraq alleged that they were underpaid a de facto policy requiring the under-reporting of time. The Munger Tolles team disproved these allegations through statistical analysis and effective cross-examination.
The case provides “a rare example of a class action trial conducted in binding arbitration,” and “the win illustrated two cutting edge employment law issues: how to conduct class proceedings in arbitration, and how to address wage and hour claims by international employees” the Daily Journal wrote.
