Munger, Tolles & Olson litigators Kristin Linsley Myles and James C. Rutten published an article on SCOTUSblog on April 18 titled “Kiobel commentary: Answers … and more questions.” The article discussed the Court’s decision in Kiobel v. Royal Dutch Petroleum Co., which presented the question of whether federal courts may recognize a cause of action under the Alien Tort Statute for violations of the law of nations occurring within the territory of a foreign sovereign. In an opinion in favor of the respondents, the Court answered that question with a “no.”
Ms. Myles and Mr. Rutten served as counsel on an amicus brief in support of the respondents in the case.
Ms. Myles’ practice focuses on complex business litigation. Mr. Rutten devotes his practice to securities litigation and shareholder derivative actions.
