Munger, Tolles & Olson attorney Kristin Linsley Myles recently published an article in the Wyoming Law Review. The article, titled “South Carolina v. North Carolina - Some Problems Arising in an East Coast Water Dispute,” will be featured in the review’s 12th volume in a section devoted to land and water division.
Ms. Myles' article examines the case, South Carolina v. North Carolina, Original No. 138, which she oversaw while acting as a U.S. Supreme Court Special Master. Her detailed analysis discusses three issues that arose in the case: the ability for non-state parties to intervene in original jurisdiction disputes between sovereign states; the source of law for such cases; and the issues raised by requests to bifurcate original cases into separate liability phases.
