Ninth Circuit Rejects Antitrust Case Over Cable TV 

Munger, Tolles & Olson attorneys secured a victory from the 9th Circuit U.S. Court of Appeals on June 3 in an antitrust case involving all of the major television programmers and distributors. 

Munger Tolles represented Fox Entertainment, which was among the cable and satellite distributors facing a class action brought by cable and satellite subscribers who claimed that “tiering” or bundling of channels was in violation of the Sherman Act. 

Munger Tolles was a primary author of the Ninth Circuit brief and presented the oral argument.

“Antitrust law recognizes the ability of businesses to choose the manner in which they do business absent any injury to competition,” Judge Sandra Ikuta wrote on behalf of a three-judge panel.
