Munger, Tolles & Olson partners Malcolm A. Heinicke and Terry E. Sanchez were chosen among the Top Labor and Employment Lawyers in California by the Daily Journal. This is the fifth consecutive ranking for Mr. Heinicke and the fourth straight year that Mr. Sanchez has been included. The list was published July 17.
Mr. Heinicke was recognized for his representation of Wells Fargo in a putative class action alleging that the banking industry’s rules regarding trading by brokers violated California’s forced patronage laws. On this novel issue, Mr. Heinicke argued in the U.S. Circuit Court of Appeals for the 9th Circuit that the federal securities laws preempt California labor law. In a unanimous opinion issued on April 9, 2013, the Ninth Circuit adopted Munger Tolles arguments, holding that federal law gives financial firms discretion to adopt trading restrictions.
The Daily Journal spotlighted Mr. Sanchez’s representation of Wells Fargo in an action by the Department of Justice over alleged discriminatory loan practices. Mr. Sanchez and the team of Munger Tolles lawyers were able to present a statistical analysis of Wells Fargo’s lending practices that cast doubt on the government’s case and led to a favorable settlement.
Based in Munger Tolles’ San Francisco office, Mr. Heinicke’s practice includes complex commercial litigation, particularly employment and false advertising class actions and employee mobility (trade secret) matters.
Located in Munger Tolles’ Los Angeles office, Mr. Sanchez’s practice includes employment litigation defense, including defending wrongful discharge, discrimination and sexual harassment actions.
