Delaware Supreme Court Affirms Munger Tolles Win on Behalf of General Reinsurance Corporation

On December 29, 2010, the Delaware Supreme Court affirmed a decision of the Delaware Chancery Court dismissing Munger, Tolles & Olson client General Reinsurance Corporation from the American International Group shareholder derivative litigation. In a case of first impression, the Delaware courts held that the doctrine of in pari delicto barred a derivative suit against third-party entities who allegedly aided, abetted or conspired with AIG's senior management in wrongdoing on behalf of the company.

Fred A. Rowley, Jr. argued the appeal. George M. Garvey argued the case in Chancery Court. Other Munger Tolles attorneys on the case included Lika C. Miyake and Jenny Huang Hong.
