Munger Tolles Obtains Key Trial Victory Over Artist’s Royalties for Universal Music Group

Glenn Pomerantz, Kelly Klaus and Melinda LeMoine successfully defended Universal Music Group against record producers seeking a precedent-setting ruling regarding royalties for sales of music purchased in the digital download format from online retailers or ringtone providers such as wireless phone companies. The jury found that FBT Productions LLC, producers for hip-hop artist Eminen, could not claim a larger percentage of royalties from sales of records in the download format than it receives when records are sold in the compact disc, cassette or vinyl format. The jury rejected FBT’s claim that it is entitled to 50% of whatever Universal receives for the sales of downloads and ringtones.
